Welcome to Mafaati!

These Terms & Conditions ("Terms") govern your access to and use of Mafaati's website and mobile application (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. User Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Platform.

2. User Accounts

You may be required to create an account to use certain features of the Platform. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to be solely responsible for all activities that occur under your account.

3. Orders and Payment

  • You can place orders for food delivery through the Platform from participating restaurants.
  • Prices listed on the Platform are set by the restaurants.
  • Mafaati may charge a delivery fee on top of the restaurant's price.
  • You agree to pay for all orders placed through your account using a valid payment method.
  • Mafaati reserves the right to modify pricing or fees at any time.

4. Content and Intellectual Property

The content on the Platform, including logos, trademarks, and design elements, is the property of Mafaati or its licensors. You may not copy, modify, distribute, or otherwise exploit any content without Mafaati's express written permission.

5. User Conduct

You agree to use the Platform in a lawful and respectful manner. You will not:

  • Use the Platform for any illegal or unauthorized purpose.
  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially or ethnically offensive.   
  • Interfere with the Platform's operation or servers.
  • Violate any applicable laws or regulations.

6. Disclaimer of Warranties

The Platform is provided "as is" and without warranties of any kind, express or implied. Mafaati disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

Mafaati will not be liable for any damages arising out of or related to your use of the Platform. This includes, but is not limited to, direct, indirect, incidental, consequential, or punitive damages.

8. Indemnification

You agree to indemnify and hold harmless Mafaati and its officers, directors, employees, agents, and licensors from and against any and all claims, demands, losses, liabilities, costs, or expenses (including attorneys' fees) arising out of or related to your use of the Platform.   

9. Termination

Mafaati may terminate your access to the Platform at any time and for any reason, with or without notice.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Delhi, India.

12. Entire Agreement

These Terms constitute the entire agreement between you and Mafaati regarding your use of the Platform.

13. Changes to Terms

Mafaati may revise these Terms at any time by posting the revised Terms on the Platform. You are bound by any such revisions.
